  1. DEFINITIONS

Building Contract means a building contract in the form required by Us to construct a Collection by Glenvill Home on the Property.

Collection by Glenvill Home means a new home from our ‘Collection by Glenvill’ range.

Upgrade your way. Select from 3 premium upgrade packages’ Options as described below:

OPTION A – Kitchen & Ensuite

Minimalist Abode (AB) upgrades

  • Kitchen option B – Provide a revised Kitchen layout, including dual wall oven towers, including the addition of a microwave and warming draw, intergraded fridge, slide out pantry, and the inclusion of cabinetry to the side wall to the added nib wall to the Kitchen and the addition of cabinetry, 600mm cooktop and undermount rangehood, single bowl sink to the nib wall, in lieu of standard.
  • Ensuites to all Bedrooms option A – Provide Ensuites 2, 3 and 4, in lieu of a Bathroom and WC.

Contemporary Residence (CR) upgrades

  • Kitchen option D – Provide a revised Kitchen layout including an integrated fridge, pull out pantry, dual wall oven towers, including the addition of a microwave and warming draw, including cabinetry into the Pantry with the addition of a 600mm cooktop and rangehood and single bowl sink to the external wall and wall backing onto the stair and the addition of a window, in lieu of standard.
  • Ensuites to all Bedrooms option A – Provide Ensuites 2, 3 and 4, in lieu of a Bathroom and WC.

Lighthouse (LH) upgrades:

  • Kitchen option D – Provide a revised Kitchen layout including an integrated fridge, pull out pantry to the Kitchen, including dual wall oven towers, including the addition of a microwave and warming draw and double door pantry unit, to the Pantry, in lieu of standard.
  • Ensuite 1 option B – Provide an Ensuite over the Garage to Bedroom 1, including the creation of a void over the Entry and additional WIR adjacent to the Ensuite.

Urban Habitat (UH) upgrades:

  • Kitchen option D – Provide a revised Kitchen layout including an integrated fridge, pull out pantry, dual wall oven towers, including the addition of a microwave and warming draw, including cabinetry into the Pantry with the addition of a 600mm cooktop and rangehood and single bowl sink to the external wall and wall backing onto the stair and the addition of a window, in lieu of standard.
  • Ensuites to all Bedrooms option A – Provide Ensuites 2, 3 and 4, in lieu of a Bathroom and WC.

Atrium Form (AF)

  • this upgrade package is not applicable to the Atrium Form home design

 

OPTION B – Energy Saver & Home Automation

Upgrades are house type specific and include:

  • Provide a 4KW Solar Pack Pro PV system with Tesla battery storage, including 14 panels, inverter, optimisers and monitoring (single phase).
  • Provide a Control4 lighting and network package including 16 channel relays, 8 channels dimming, 12 configurable keypads, an entertainment and automation controller, smart phone app, 2 motion sensors, touch screen, an 8-port PoE switch, wireless router and 2 wireless access points, including commissioning.
  • Provide an add on security system including 8 sensors, garage door reed switch and door controller, to the control4 starter package

 

OPTION 3 – Heat & Cool

Upgrades are house type specific as set out in Glenvill Homes Upgrade Options List and include:

  • Provide all electric air-conditioning systems, up to 17 ceiling outlets serving 4x zones, 2x control panels, in lieu of standard ducted heating. Subject to final design and Owner’s requirements.

Fireplace option – Provide a Jetmaster Heat and Glo 3X fireplace to the Living room side external wall, with a porcelain plinth base

GST means GST within the meaning of the A New Tax System (Goods and Services Tax) Act 1999 (as amended).

New Customer means anyone who has not yet signed a Preconstruction Works Agreement 1.

Offer means our offer to provide you with one upgrade package from the specified options subject to and in accordance with these Terms

Preconstruction Works Agreement means an agreement in the form required by Us for Us to commence design works and obtain information in relation to the Property.

Promotion means the ” Collection- Have it all and more. Upgrade your way with your choice from 3 premium packages’ Promotion”.

Property means the property to which the Preconstruction Works Agreement and the Building Contract relate.

Terms means these terms and conditions.

Unconditional means that:

  • if the Building Contract contains a provision that it was subject to finance approval, that that provision has been satisfied;
  • if the Building Contract contains a provision that it was subject to the Your lawyer’s approval of the terms of the Building Contract, that that provision has been satisfied;
  • the deposit to be paid by You under the Building Contract has been paid in full; and
  • the ‘cooling off’ period under the Building Contract has expired, and You have not exercised Your right to end the Building Contract.

We, Us and Our means Glenvill Homes Pty Ltd ABN 55 298 953 760 of 480 Church Street, Cremorne, Victoria 3121.

You or Your means the person or persons entitled to participate in the Promotion.

    1. OFFER

    Subject to the Exclusions and these Terms, we will provide one premium upgrade package as specified to the Property free of charge to You.

    1. PROMOTION
      • These terms govern the Offer and Your participation in the Promotion.
      • Only persons above 18 years of age are eligible to participate in the Promotion.
    2. ELIGIBILITY
      • In order for You to qualify for the Promotion, You must:
        • be a New Customer;
        • enter into a Preconstruction Works Agreement and pay the required deposit under that agreement by no later than 14th July 2021;
        • enter into a Building Contract by no later than 30th September 2021.
      • Provided:
        • You satisfy the requirements of clause 3(b); and
        • the Building Contract becomes Unconditional within 21 days of the date that the Building Contract is entered into,

    the Promotion and Offer is available to You.

    • You acknowledge and agree that if:
      • You do not satisfy the requirements of clause 3(b); or
      • the Building Contract does not become Unconditional within 21 days of the date that the Building Contract is entered into; or
      • the Building Contract is terminated by Us or You prior to it becoming Unconditional,

    You will not be entitled to participate in the Promotion.

    1. ADDITIONAL COSTS

    You acknowledge and agree that:

    • Any additional items requested by clients outside of the set out inclusions described in the above premium upgrade package options will be treated as a variation to the base price of the home.

     

    1. UNAVOIDABLE EVENTS

    We will not be required to comply with Our obligations in these Terms, to the extent that We are prevented from doing so by reason of delay or inability to perform caused by pandemic (including Covid-19), epidemic, war, whether declared or not, civil rebellion, strike, fire, storm or other severe action of the elements, accident, government or statutory restriction or from other similar causes which are unavoidable or beyond Our reasonable control.

    1. MISCELLANEOUS
      • These Terms contain the entire agreement between You and Us relating to the Promotion.
      • The Offer is not valid with any other promotion, discount or offer available from Us.
      • Components of the premium package upgrades may not be mixed and matched or altered in any way.
      • The Offer is only available to New Clients who meet these Terms, and otherwise comply with the terms and conditions of the Building Contract.
      • Our standard Building Contract conditions apply.
      • We reserve the right to:
        • amend these Terms; and
        • to extend, vary or terminate the Offer,

    at any time without prior notice.

    • Any previous understanding, agreement, representation or warranty relating to the Promotion or the Offer is replaced by these Terms and has no further effect.
    • These Terms are governed by and must be construed in accordance with the laws of the State of Victoria and You agree to submit to the exclusive jurisdiction of the Courts of that State and the Commonwealth of Australia in respect of all matters or things arising out of these Terms.
    • If any of these Terms (or any parts thereof) are held by any Court of competent jurisdiction to be ineffectual, invalid or unenforceable, the remaining Terms (or parts thereof) shall not be affected thereby and shall remain in full force and effect.
